- An IP posted on this page: "Whoever posted this picture of Pastor should know that if he had lived to see this he would have been absolutely horrified. He would not approve of his photo being displayed in such a manner." In fact, I agree this appears to be a professional photo, and the uploader hasn't given any indication of why/how s/he is the owner of the copyright other than just stating GFDL-self. - Technically a 3D artwork, as is not just text. It's post 1978 when U.S. copyright law changed. Ronhjones (Talk) 01:39, 6 November 2011 (UTC)[reply]
- I took this photograph myself, and released it under SA 3.0... - Adolphus79 (talk) 15:24, 6 November 2011 (UTC)[reply]
- By that rational, how do we have photographs of any other statue, artwork, or other public displays on this website? I am not claiming copyright of the marker itself, only the photograph of the marker. Please explain how to photograph the marker, and upload it... - Adolphus79 (talk) 19:08, 12 November 2011 (UTC)[reply]
- If depends where the statue is and when it was erected. A lot of countries (mine included) let you take pictures of anything in a "public place" without any problems - it's called Freedom of panorama. Sadly the USA decided not to do that, it only applies to buildings, not sculptures/monuments/memorials. If erected pre-1978 (when US copyright laws starting changing) then it's probably OK, otherwise the creator of the sculpture has the copyright, and to show here, one has to get permission from him/her. There is more info about how the US copyright acts affect 3D artworks at commons:Freedom_of_panorama#United_States. Ronhjones (Talk) 23:11, 12 November 2011 (UTC)[reply]

- Wow, I didn't even know about that... that's just bullshit (not directed at you, but my own government)... My only concern is the number of images of historical markers, etc. that are up here on Wikipedia, and the loss of such documentation... I guess I am out of this discussion, and will leave it up to those that are better informed on the subject to decide... - Adolphus79 (talk) 14:56, 13 November 2011 (UTC)[reply]
- It doesn't seem to well publicised. To us it looks like the land of the free is the land of the lawyers... Have a holiday in the UK, you can take all the photos you want - even inside museums (they are still a public place), also Germany and Switzerland are good. - The upload text says "Since the person died in 1931 its image can be contributed in public domain." So the uploader is not the original photographer.
Perhaps {{PD-India}} would apply here. But it would be nice with a little more info. MGA73 (talk) 10:45, 6 November 2011 (UTC)[reply]
- I do agree with you. Since the person died in 1931 obviously this photo might have been published in India before 1951. I have replaced the old tag of licencing with new {{PD-India}} on its file description page to which please see.
- Thank you very much for guiding me.
- With regards I hope this image will not be deleted now

- Gnu license assigned by the uploader is not compatible with the license at the source. Also the license at the source states "provided that the content is not altered and the source is acknowledged" which is not compatible with Wikipedia. Eeekster (talk) 22:50, 6 November 2011 (UTC)[reply]
- The website where I got it from claims that it can be used as long as it's not altered in any way. Bastian (talk) 18:21, 7 November 2011 (UTC)[reply]
- That is precisely the problem. A license must allow alteration to be "free enough" for use on Wikipedia. Danger High voltage! 19:07, 7 November 2011 (UTC)[reply]
