The uploader claims that the image is a work of the US Government, but sources it to the British Consulate in the US, which is a branch of the British Government. As such, it'll be covered by Crown Copyright. Since images under this licence are only usable under Fair Use these days, and there are many other images of Brown already available here and on Commons, there's no reason to keep this.
