The 2019 Brecon and Radnorshire recall petition was a recall petition under the provisions of the Recall of MPs Act 2015 in the UK parliamentary constituency of Brecon and Radnorshire. It followed the conviction of its Member of Parliament (MP) Chris Davies for false expenses claims, and resulted in Davies being removed from the seat.
Background
Chris Davies was charged with false expenses claims, pursuant to the Parliamentary Standards Act 2009.[1] He pleaded guilty in March 2019[2][3] and, in April, was sentenced to a community order of 50 hours unpaid work and a £1,500 fine.[4] The Recall of MPs Act 2015 mandates that all convictions of sitting MPs for providing false or misleading expenses claims automatically initiate the recall processes.
Process
After receiving notice from the sentencing court, the Speaker of the House of Commons indicated on 24 April 2019 that he would be instructing the constituency's petition officer to begin the recall process.[4] The petition opened on 9 May and remained open for signatures until 20 June 2019.[5] It required 5,303 signatures (10% of eligible voters) to be successful.[6][7]
Result
The petition was successful and Davies was removed from the seat.[8]
10,005 people signed the petition, significantly exceeding the threshold of 5,303 signatures (10% of the electorate) needed to trigger a by-election.[9] A by-election will be held later this year.
